Acta Universitatis Carolinae Iuridica (AUCI) is the main journal of the Faculty of Law of Charles University. It has been published since 1954 and is one of the traditional law journals with a theoretical focus.

As a general law journal, it publishes longer studies and shorter articles on any relevant issues in legal theory and international, European and national law. AUCI also publishes material relating to current legislative issues. AUCI is a peer-reviewed journal and accepts submissions from both Czech and international authors. Contributions by foreign authors are published in their original language – Slovak, English, German, French.

AUCI is a theoretical journal for questions of state and law. It is published by Charles University in Prague, Faculty of Law, through Karolinum Press. It is published four times a year, the dates of publication can be found here.

Articles published in AUCI undergo an independent peer review process, which is anonymous on both sides. Reviewers from the field give their opinion on the scientific quality of the paper and the suitability of publication in the journal. In the case of comments, the opinion is sent back to the author with the possibility of revising the text (see Guidelines for Authors – Per Review Process for more details).

The AUCI journal (ISSN 0323-0619) is registered in the Czech National Bibliography (kept by the National Library of the Czech Republic) and in the Index to Foreign Legal Periodicals (kept by the American Association of Law Libraries). AUCI has been assigned a periodical registration number MK E 18585.

In 2021 the journal AUCI was the first journal of the Faculty of Law of Charles University to be included in the prestigious international database Scopus. This Elsevier database is the largest abstract and citation database of peer-reviewed literature in the world. The editors of the journal expect from the inclusion in the elite Scopus database not only an increase in the readership of the journal, but also an increase in interest in the publication of papers by both Czech and foreign authors.

AUCI is an open journal and all its content is published both on the faculty website and on the Karolinum Press website. Access to it is free of charge. The homepage of AUCI is on the Karolinum Press website.

[Fight Against Corruption Through Means of European Law]

abstract

The problem of corruption has come to the forefront at the international level since the beginning of the 1990is. In the beginning were adopted not legally binding documents. The Inter-American Convention against Corruption was the first international convention ever adopted in the history. The Convention against Transnational Organized Crime represents the first convention that was adopted at the general universal level. The European Union is fighting against the types of corruption, which damage or corrupt the European Communities’ financial interests, interference in impartiality of the officials or in economic competition. In 1996 the Council of European Union adopted the Convention on the protection of the European Communities’ financial interests, in which there isn’t obligation to criminalize corruption. The obligation to criminalize corruption action which damages or likely to damage the European Communities’ financial interests committed by Community officials or officials of another Member state is consists in the Protocol to the Convention. The second Protocol, not yet in force, requests to ensure that the legal person can be held liable for active corruption. Also the Convention on the fight against corruption involving officials of European Communities or officials of Member States of the European Union requests the criminalize corruption action with participation of Community officials or officials of another Member state. This corruption action doesn’t have to damage the European Communities’ financial interests. The convention defines active and passive corruption, principle of assimilation, jurisdiction, cooperation etc. and requests effective proportionate, dissuasive penalties. The convention hasn’t come in force yet. The aim of the Council Framework Decision 2003/568/JHA of 22 July 2003 on combating corruption in the private sector is in particular to ensure that both active and passive corruption in the private sector are criminal offences in all Member States, that legal persons may also be held responsible for such offences, and that these offences incur effective, proportionate and dissuasive penalties. The Czech law is in accordance with the requirements resulting from the Convention, Protocols and Framework Decision. The concept of official falls within the provision 89 par. 9 and art. 162a par. 2 of Criminal Code. The corruption behavior that should be criminalizes falls within the art. 160 and 161 of Criminal Code. Advantages of any kind are described as bribe in the art. 162a par. 1 of Criminal Code. Sanctions could be recognized as a problem in the Criminal Code. They could be found too lenient. Finally, the Czech legal system does not recognize a criminal liability of legal persons.
