Information disclosure at Charles University, Karolinum Press
This Decision sets out the information disclosure procedure at Charles University in accordance with Act No. 106/1999 Coll. on Free Access to Information, as amended (hereafter referred to as the Act), for the purposes of Karolinum Press.
Article 1
Karolinum Press (hereafter referred to as KP) is a special-purpose facility of Charles University responsible for the university’s publishing activities pursuant to the internal regulations of Charles University in accordance with Section 22 (1) (d) of Act No. 111/1998 Coll., on Higher Education Institutions and on Amendments and Supplements to Some Other Acts, as amended (the Higher Education Act).
Article 2
KP as a facility of Charles University is subject to the internal regulations of Charles University.
Article 3
1. Information about KP’s activities, especially pertaining to Section 3 (7) of the Constitution of CU, is disclosed by the Secretariat of KP. The person responsible is the deputy Director of KP.
2. Information about publications published by KP, such as pricing, points of sale, options for cash-on-delivery or invoice-based ordering, i.e., information related to the commercial and distribution activities of KP, is generally available to the extent presented on KP’s website at cupress.cuni.cz. This information is excluded from this Decision.
3. If the requested information concerns other special-purpose facilities, faculties, or departments, the corresponding request shall be sent to each of these.
Article 4
1. Requests for information disclosure in accordance with the Act shall be submitted by mail to Nakladatelství Karolinum, Ovocný trh 560/5, 116 36 Praha 1.
2. Requests may also be sent by e-mail to cupress@cuni.cz.
3. Other submissions under the relevant provisions of the Act may also be made using the above-mentioned methods.
Article 5
1. Submissions shall have the particulars referred to in Section 14 (2) of the Act, and if sent by fax or e-mail, they shall also contain information to verify the identity of the applicant. Failure to do so shall result in the submission not being deemed a request as per the Act and being deferred in accordance with Section 14 (2).
2. The request header (the “Subject” line for e-mail requests) must clearly indicate that the request concerns the disclosure of information under the Act.
Article 6
1. The Director shall act on behalf of KP regarding information disclosure in accordance with the Act upon receipt of a written request (including requests made by fax or e-mail) unless this concerns decisions pursuant to Article 7 or Article 9.
2. Written requests for information disclosure under Section 1 shall be handled by the Secretariat of KP within the time limits and in the manner specified in the Act and in this Decision. The Secretariat shall also keep records of received requests and their handling.
3. If the handling of a request requires the assistance of another department of KP, the latter shall provide the necessary information to the Secretariat of KP upon request.
4. Oral requests (made in person or by phone) are handled by the Secretariat of KP. If the applicant does not consider the reply sufficient, they may submit a written request.
Article 7
Decisions on non-disclosure or partial disclosure of the requested information (Section 15 of the Act) shall be issued by the Director of KP. The decision shall be made in writing and delivered to the addressee only.
Article 8
1. An estimate of processing costs shall be made upon receipt of a request for information disclosure. The calculation shall be carried out in accordance with the Act, other regulations, and the tariff set out in the Annex to this Decision. If the actual processing costs are to exceed the estimated costs by more than 15%, the applicant shall be informed thereof.
2. If the cost estimate does not exceed CZK 100, no reimbursement is required. Otherwise, the applicant is informed of the cost estimate and asked whether they wish to proceed with the request.
3. Once the requested information is processed, the applicant shall be asked in writing to settle the actual costs and provide proof of repayment. Upon receipt of the proof, the Secretariat of KP shall promptly disclose the requested information to the applicant.
4. If the cost estimate exceeds CZK 3,000, an upfront payment of 30–50% of the cost estimate is required. The processing of the requested information can only begin after the upfront payment is made.
5. The calculation of the cost estimate and the actual amount shall be approved by the Director of KP.
6. Payments shall be made by bank transfer to account No. 84735-011/0100, using the variable symbol 950600.
7. The time limit for information disclosure shall be suspended in the period between the applicant having been sent a notice under Sections 1, 2, 3, or 4 and KP having received the applicant’s reply.
Article 9
1. An appeal may be filed against a negative decision on a request for information disclosure issued pursuant to Article 7 or issued by a body of the faculty or another department of Charles University within the time limit and in the manner specified in Section 16 of the Act.
2. Appeals shall be submitted to the Rector of Charles University through the Director of KP, exclusively in writing.
3. All appeals must contain the applicant’s full name, address, a copy of the negative decision, a description of the alleged violation of the Act or other regulations, and signature. The heading of the appeal shall state that it concerns information disclosure under the Act.
4. The Director of KP, as the issuer of the challenged decision, may grant the appeal in its entirety by issuing a new decision. Otherwise, they shall immediately refer the appeal along with the case file to the Rector of Charles University.
5. A duly filed appeal will be reviewed by the Rector of Charles University within 15 days from receipt; the documents for this decision are prepared by the Auditing Department of the Rector’s Office. Article 6 shall apply accordingly to cooperation with this department.
6. The Rector shall annul the challenged decision if it was issued in breach of the Act or other applicable regulations; in such a case, the request shall be reopened, with the Rector’s legal opinion binding on the Director of KP, who had issued the original decision. Otherwise, the Rector shall dismiss the appeal.
7. The Rector’s decision is final and will be delivered by the deadline defined in Section 16 of the Act to the addressee only.
Article 10
The Secretariat of KP shall provide the Auditing Department of the Rector’s Office with an annual summary of submitted and handled requests within the time and in the manner requested by the latter.
Article 11
The report on KP’s activities related to information disclosure (Section 18 of the Act) is part of the annual report on KP’s activities.

1. This Decision shall be made available on KP’s homepage at cupress.cuni.cz
2. This Decision shall enter into force on 1 November 2001.

Costs incurred by the university in connection with the procurement of information that are payable to a third party shall be charged in full.
