summary

The collective examines from a legal-historical point of view the question of the extent to which courts in their praxis in the Czech Lands in the 18th– 20th centuries were governed by the literal wording of applied legal regulations and to what extent their decision-making went beyond this framework. The authors investigate this question in the case of selected legal institutions of civic, administrative, criminal and economic law by means of analyses of period sources of law as well as current analyses of the applied praxis of legal bodies in the 18th– 20th centuries. Readers can ascertain that some of the difficulties encountered by the judicial system today are nothing new and that the law had to deal with them also in previous periods when resolving the perpetual conflict between the law and justice.
