summary
By analysing selected thinkers and contemporary sources, the publication demonstrates that the right to war in the Middle Ages and early modern period was not a uniform institution, but rather a set of rules that kept evolving under the influence of religious, political, and social factors. Certain distinctive elements appear consistently in both philosophical and legal sources. These include a shift from theological ideas toward more natural-law and rationalist foundations, as well as an emphasis on the power of the sovereign. However, in some respects, theory and practice differ in interesting ways, as illustrated, for example, by the contractual and communal aspects of medieval and early modern right to war.
