This selection of texts contains Jürgen Habermas’s papers and supplementary texts on his discursive political and legal theory on the democratic rule of law, which he systematically elaborated in his monumental book, Faktizität und Geltung. Beiträge zur Diskurstheorie des Rechts und des demokratischen Rechtsstaats (1991). It is the second major work of the "mature" Habermas in the area of "practical philosophy,” in which he follows up, in a very complex manner, his previous, equally monumental book entitled Theorie des kommunikativen Handelns (1981). Habermas’s attempt at a discursive explanation of liberal democracy is an organic part of traditional discussions in German political and legal theory, demonstrating systematic reception of Anglo-Saxon discussions, and follows up, albeit in an intricate manner, the previous stages of Habermas’s thinking and fulfills his basic intentions in a new way.
